1. Sale and Purchase of Goods

Jiva Journey (“Seller”) hereby agrees to sell, and you (“Buyer”) hereby agree to purchase, goods as described in the checkout window (“Checkout”) on the terms and conditions set forth in this Agreement.

2. Purchase Price

Buyer agrees to pay the purchase price of the goods as posted on this website at the time of checkout.

3. Payment Terms

The total purchase price shall be payable in full by Buyer as specified at Checkout. Any portion unpaid after thirty (30) days is overdue. Overdue amounts are subject to a late charge of the lesser of one and one-half percent (1.5%) per month (18% per annum) or the highest lawful rate. Seller may seek legal remedies and will be entitled to reimbursement for collection costs, including attorney fees and related expenses.

4. Delivery

Delivery shall be in accordance with Seller’s shipping policy at the time of shipment. Delivery dates provided by Seller are estimates, and while efforts will be made to meet these dates, Seller is not liable for delays. Goods will be packaged according to Seller’s standards unless otherwise agreed in writing.

5. Limited Warranty

Jiva Journey provides a warranty that goods purchased from this website will be free from defects for one year. This warranty is governed by Seller’s warranty policies in effect at the time of shipment.

6. Disclaimer of Warranty/Limitation of Liability

Except as provided in this Agreement, Seller disclaims all other warranties, express or implied, including for fitness for a particular purpose.

SELLER AND ITS AFFILIATES ARE NOT LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR EXEMPLARY DAMAGES RELATED TO THE GOODS, INCLUDING LOSS OF PROFITS, DATA, OR USE. IN NO EVENT SHALL SELLER’S LIABILITY EXCEED THE NET PURCHASE PRICE OF THE GOODS PAID BY BUYER.

7. Force Majeure

Seller is not responsible for delays or failure to perform due to causes beyond its reasonable control, such as government action, labor issues, or natural events. Seller will determine the extent to which such conditions affect performance.

8. General

This Agreement cannot be assigned by Buyer without Seller’s consent. Any conflicting agreements are overridden by this Agreement unless modified in writing. This Agreement is governed by Virginia law, with disputes resolved in Virginia courts.

Blog and Message Board Terms of Use

1. Disclaimer of Responsibility for Blog Content

Content posted to the Blog is the sole responsibility of the individual poster and does not reflect Jiva Journey’s opinions.

2. Posting

By posting content, you grant Jiva Journey the rights to use and distribute your content as specified, and you affirm that you own or control all rights to your content.

3. Accessing

Jiva Journey is not liable for errors or omissions in Blog content. Use of the Blog is at your own risk.

4. Children

Collection of personal information from minors is prohibited.

5. Privacy Policy

7. Termination of Access/Removal of Content

Jiva Journey may terminate access or remove content if it deems any material inaccurate, illegal, or otherwise objectionable.
